Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and HomeSown LLC ("HomeSown," "we," "us," or "our") governing your use of the HomeSown application and website at HomeSownApp.com (together, the "Service").

By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.


1. The Service

HomeSown is a gardening companion: a plant library, a personal garden tracker and archive, a plot/bed planner, weather- and climate-aware reminders, and optional premium AI features (a gardening assistant chat, recipe generation from your harvests, and an AI photo-identification camera). We may add, change, or remove features over time.

2. Eligibility and accounts

  • You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Service. The Service is not directed to children under 13.
  • You are responsible for your account credentials and for activity under your account. Keep your password secure and notify us of any unauthorized use.
  • You agree to provide accurate information and to keep it current.

3. Informational purpose only — important disclaimers

Read this section carefully. It defines what HomeSown is and is not.

  • The Service is for general informational and educational purposes only. It is not professional, agricultural, horticultural, medical, nutritional, or safety advice, and it is not a substitute for the judgment of a qualified professional.
  • Plant identification, toxicity, edibility, and pest/disease information may be incomplete, inaccurate, or out of date. Plants can be misidentified, and many plants (or parts of plants) are toxic to humans or animals. Never eat, handle, or use any plant, fruit, or fungus based solely on the Service. Always independently and positively identify a plant with a qualified expert before consuming or using it. When in doubt, do not eat it.
  • AI-generated content can be wrong. The AI assistant chat, AI-generated recipes, and AI Camera identifications/diagnoses are produced by automated systems and may contain errors or "hallucinations." Treat all AI output as suggestions to verify, not as fact. This applies with special force to anything involving edibility, toxicity, allergies, or food safety — confirm independently before acting. Recipes are not reviewed by a nutritionist or food-safety professional; you are responsible for safe food handling and for your own dietary and allergy needs.
  • Gardening outcomes are not guaranteed. Weather, climate data, frost dates, and planting calendars are estimates based on third-party data and historical normals. We do not guarantee any harvest, yield, plant survival, or result, and we are not responsible for crop loss or damage.
  • No reliance for safety-critical decisions. Do not rely on the Service for any decision where an error could cause injury, illness, or loss.

You use the Service at your own risk and are solely responsible for decisions you make based on it.

4. Your content

  • You own your content. You retain ownership of the garden data, notes, photos, messages, and other content you submit ("User Content").
  • License to operate the Service. You grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, process, transmit, and display your User Content solely to provide and improve the Service for you (for example, storing your garden, sending your AI Camera photo to the model provider to generate your answer, or generating a recipe from your inputs). This license ends when you delete the content or your account, except for residual backup copies as described in the Privacy Policy. We use your User Content only to provide and improve the Service for you, as described in the Privacy Policy.
  • AI inputs. When you use an AI feature, your inputs are processed as described in the Privacy Policy. AI Camera photos are analyze-and-discard and are not retained by us.
  • Responsibility. You represent that you have the rights to the content you submit and that it does not violate these Terms or any law or third-party right.

5. Acceptable use

You agree not to:

  • use the Service for any unlawful purpose or in violation of these Terms;
  • upload content that is illegal, infringing, harmful, harassing, or that you have no right to share;
  • attempt to gain unauthorized access to the Service, other accounts, or our systems; probe, scan, or test security without authorization;
  • scrape, harvest, or bulk-extract data from the Service except as expressly permitted;
  • abuse, overload, or attempt to circumvent rate limits, usage caps, or the AI budget/fair-use controls;
  • resell, sublicense, or commercially exploit the Service or its content without our permission;
  • misuse the AI features (e.g. to generate content unrelated to gardening, or that is harmful or abusive).

We may suspend or terminate accounts that violate this section.

6. Subscriptions and payments

HomeSown offers an optional premium subscription that unlocks the AI features (assistant chat, recipe generation, AI Camera) and removes free-tier limits. The free tier remains usable without payment.

  • Plans and price. Premium is $4.99 per month or $49.99 per year, with a 14-day free trial for new subscribers. We may change prices going forward with reasonable notice; a price change will not affect a period you have already paid for.
  • Free trial and auto-renewal. Unless you cancel before it ends, your free trial automatically converts to a paid subscription, and your subscription then automatically renews at the end of each billing period (monthly or yearly) at the then-current price until you cancel. You authorize us and our payment processor to charge your payment method on each renewal.
  • Billing channel. On the web, billing is processed by Stripe. In the iOS and Android apps, billing is processed through the Apple App Store or Google Play in-app-purchase systems and is additionally governed by their terms. Your store account may differ from your HomeSown login; premium access is tied to your HomeSown account.
  • Cancellation. You can cancel anytime — on the web through the Stripe billing portal, or in your App Store / Google Play subscription settings for in-app purchases. When you cancel, your premium access continues until the end of the current paid period and you will not be charged again. We do not provide refunds for partial periods except where required by law.
  • Refunds. Except where required by law, subscription fees are non-refundable, including for partial billing periods after you cancel — your 14-day free trial is the opportunity to evaluate Premium before you are charged. Purchases made through the Apple App Store or Google Play are subject to those platforms' refund policies, which we do not control.
  • Free vs. premium. The free tier limits how many plants you can actively track and plan, excludes the AI features and the Plot Planner auto-arrange, and shows ads; premium removes those limits, unlocks the AI features, and is ad-free. The specific limits are shown in the app at the point of upgrade.
  • Automatic-renewal terms. Before you start a paid subscription, we present — clearly and conspicuously — that the subscription auto-renews, the recurring price and billing frequency, the trial length, and how to cancel, and you affirmatively consent to these terms at checkout. You may cancel at any time as described above, effective at the end of the current period, and we will send any renewal or price-change notices required by applicable law (for example, California's Automatic Renewal Law).

7. Intellectual property

The Service — including the plant library content, guides, software, design, logos, and the "HomeSown" name and branding — is owned by us or our licensors and is protected by intellectual-property laws. We grant you a limited, personal, non-transferable, revocable license to use the Service for its intended purpose. You may not copy, modify, distribute, or create derivative works of the Service except as allowed by these Terms or applicable law. Plant images may be licensed from third parties and are credited on our image-attribution page; their licenses govern their reuse.

8. Third-party services and links

The Service relies on third-party providers (see the Privacy Policy) and may link to third-party content or, in the future, partner/affiliate offerings. We are not responsible for third-party services, content, or products, and your use of them is subject to their terms.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any information (including plant, toxicity, pest/disease, weather, or AI-generated content) is accurate, complete, or reliable. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HomeSown LLC AND ITS OWNERS, EMPLOYEES, AND PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, CROPS, OR HARVEST, OR FOR PERSONAL INJURY OR ILLNESS, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE OR YOUR RELIANCE ON ANY CONTENT — INCLUDING ANY PLANT IDENTIFICATION, TOXICITY/EDIBILITY INFORMATION, OR AI-GENERATED OUTPUT — EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (a) the amount you paid us in the 12 months before the claim, or (b) USD $100. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless HomeSown LLC and its owners and providers from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your User Content, your use of the Service, or your violation of these Terms or any law or third-party right.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Service or other users. Sections that by their nature should survive termination (including §§3, 4 (license tail), 7, 9, 10, 11, and 14) survive.

13. Changes to the Service and these Terms

We may modify the Service or these Terms. For material changes to the Terms, we will provide reasonable notice (e.g. in-app or by email) before they take effect. Your continued use after changes take effect constitutes acceptance. If you do not agree, stop using the Service. (Material changes to how we handle your personal data are additionally governed by the Privacy Policy's notice-and-opt-in commitment.)

14. Governing law and disputes

These Terms are governed by the laws of the State of Alabama, without regard to conflict-of-laws rules.

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO SUE IN COURT AND TO PARTICIPATE IN A CLASS ACTION.

  • Informal resolution first. Before starting a formal proceeding, you agree to contact us at Support@HomeSownApp.com and give us 30 days to try to resolve the dispute informally.
  • Binding individual arbitration. Except for the carve-outs below, any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by final and binding arbitration on an individual basis, administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The arbitration is conducted in English and, for claims that can be decided on documents, may proceed remotely. Judgment on the award may be entered in any court of competent jurisdiction.
  • Class-action waiver. You and HomeSown agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims or preside over any representative or class proceeding.
  • 30-day opt-out. You may opt out of this arbitration agreement by emailing Support@HomeSownApp.com within 30 days of first accepting these Terms, stating your name and that you opt out of arbitration. Opting out does not affect any other part of these Terms.
  • Carve-outs. Either party may (a) bring an individual claim in small-claims court, and (b) seek injunctive or other equitable relief in court to protect its intellectual property or stop unauthorized access to the Service. Any dispute not subject to arbitration (including if the class-action waiver is found unenforceable) will be brought exclusively in the state or federal courts located in Alabama, and you consent to their personal jurisdiction and venue.
  • Severability. If the class-action waiver is held unenforceable as to a particular claim, that claim (and only that claim) will proceed in court; the remainder of this section stays in effect.

15. Miscellaneous

  • Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service.
  • Severability. If any provision is unenforceable, the rest remains in effect.
  • No waiver. Our failure to enforce a provision is not a waiver.
  • Assignment. You may not assign these Terms; we may assign them in connection with a merger, acquisition, financing, or asset transfer (subject to the notice provisions of the Privacy Policy).
  • Apple App Store (additional terms). If you download the app from the Apple App Store, you acknowledge that: these Terms are between you and HomeSown only, not Apple, and Apple is not responsible for the app or its content; Apple has no obligation to provide maintenance or support for the app; in the event the app fails to conform to any applicable warranty, Apple may refund the purchase price (if any), and to the maximum extent permitted by law Apple has no other warranty obligation; Apple is not responsible for addressing any claims relating to the app (including product-liability, legal/regulatory-compliance, or consumer-protection claims) or any third-party intellectual-property claim; and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Your use of the app must also comply with the App Store Terms of Service.
  • Google Play. If you obtain the app from Google Play, the Google Play Terms of Service also apply to your use of it.
